Furbug Emporium Terms and Conditions of Service

by commissioning Furbug Emporium you are agreeing to these terms and conditions and give your consent to follow them.

 

Costume Commissions(These terms and conditions apply to all fursuit parts from tails to full fursuits unless specified otherwise):

These are my terms and conditions of service(tacos). By commissioning me and paying your deposit, you are accepting these terms and conditions and entering into a legally binding contract, please read them carefully.

Costume designer and fabricator.

 

Furbug Emporium provides the service of making fully custom full body costumes and costume pieces, your contract will be for this service only.

 

Any initial consultation, quote, or discussion regarding a commission is free, and there is no obligation on you to commission any work.

 

I have no obligation to begin any work on any commission until I have received the requested deposit payment and any materials you are providing yourself.

 

Payment of the requested deposit will confirm you accept these terms and conditions as part of the contract between us.

 

Any initial quote is subject to change before the final price is agreed upon.

 

Specification for the costume will be as instructed by you, a clear visual reference image is necessary. Copies of any notes taken by myself are available upon request.

 

Later changes to your instructions that will require additional work may incur additional charges.

 

Any changes to the fabrics detailed in the specification of the commission will incur an additional cost on top of any fabric already approved by you for purchase. The best available images of the fabric will be provided to you for approval. Physical swatches of fabric can be provided at an additional cost. If I am authorised to buy fabric at my own discretion, any changes to fabric requested by yourself after the initial fabric is purchased will incur an additional cost. Any uncut fabric will be provided to you upon request for an additional fee.

 

Upon acceptance of the final quote, I require a non refundable deposit.

 

Payment of the deposit signifies your acceptance of these terms and conditions.

 

Commissions are usually paid for via a payment plan which is discussed with you and agreed upon and specific to your commission.

 

I will try my best to meet any deadline you may have for your commission if I am told about them during the initial consultation and provided you fully cooperate in terms of making decisions on time and keeping up to date with payments, however, unless explicitly stated in writing, I will not guarantee work will be finished by a specific date.

 

If any payment is delayed, any agreed upon deadline will be void.

 

I am not liable for any delay to the commission for reasons beyond my reasonable control.

 

Acceptance of urgent/rush commissions is done via my discretion and any guarantee for work to be finished in a short time frame will attract a premium charge.

 

There is a cancellation fee if you choose to cancel your commission after work has begun. The fee will be calculated from the hours spent on the piece as well as materials, and anything else purchased on behalf of the customer, this includes any time spent researching anything related to the commission.

 

Cancellations made after any fabric has been cut will incur the full cost of the commissioned piece. Other Items purchased on behalf of the customer will be returned upon written request once the cancellation fee has been fully paid.

 

Measurements for your commission will be taken via a tape dummy that you will need to create, and then mail to me. It is important you ensure the tape dummy is accurate to your size. I am not liable for any discrepancies in size of the commissioned piece if the tape dummy is inaccurate.

 

You must let me know about any factors that may change your size or weight(including but not limited to; weight change plans, illness/recovery) as these factors may change how the piece may fit.

 

If you request in person fittings, you will be required to pay for all travel, time, potential accommodation, and any incidental expenses.

 

I have reliable suppliers for materials, and I recommend that you allow me to purchase fabrics on your behalf.

 

I reserve the right to refuse to work with unsuitable fabrics and materials.

 

The costume will only be shipped to you after full payment of the commission has been received.

 

All costume pieces belongs to Furbug Emporium until the commission is completely paid for.

 

Payment is only accepted via paypal or (occasionally)via bank transfer, I reserve the right to wait for any payment to clear before beginning any work.

 

Costumes shipped to clients will be sent via recorded delivery only and will be insured for the full value of the piece, shipping is paid for by the customer.

 

If any payment remains outstanding after delivery, for any reason, any action by the customer which affects the value of the piece with respect to the full price invoiced(including but not limited to; wearing, laundering, altering by third parties, storage, etc) will be considered damage to my property, the value of which is the full invoiced price.

 

If payments are late by more than a working calendar week(5 days not including weekends) I will charge a late payment fee of 10% of the original payment per month. If payment remains outstanding by more than 6 months, I reserve the right to take action to recover the debt and/or to cancel the commission and invoke cancellation fees.

 

Upon delivery of the costume, you must confirm that the piece(s) are as ordered.

 

You must notify me within 3 days if there is any damage to the piece, or if the piece is not as specified in the contract, after 3 days, it shall be deemed that the piece(s) have been made in accordance to your instruction, are free from defect and you have accepted them.

 

All other warranties, whether express or implied, by statute or otherwise, are excluded to the fullest extent permitted by the law.

 

In the event of a breach of contract, no refund will be given.  Furbug Emporium will keep the fursuit/costume and sell it to somebody else, in most cases the fursuit/costume will be edited so it does not look identical to the character it was commissioned for.

 

I will not take fursuit/costume commissions from anyone under 18. I will however, if you are under 18, allow a contract to be made with your parent(s) or legal guardian(s) on your behalf, at the expense that parental figures and guardians are aware that making a fully custom fursuit for someone under the age of 18 subjects the costume to being grown out of quickly.

 

All full fursuits, halfsuits, 3/4 suits, bodysuits, partial fursuits, etc require a non-refundable deposit.

 

All payments sent to Furbug Emporium are NON-REFUNDABLE.

 

By commissioning Furbug Emporium you are agreeing that you understand the style and quality of the costume you are paying for.

 

Furbug Emporium will not create a costume of a copyrighted character without the owner's consent.

 

Furbug Emporium are always allowed to use any and all photos of the costume.

 

By contracting with Furbug Emporium, and paying my deposit, I acknowledge that I have read these terms and conditions for costume design and fabrication service set out by Jade Rogers of Furbug Emporium and agree to be bound by them.
